The requirement for foreign companies to divest up to 51% in IUP
Licenses for 10 years after production will not make investors put their
feet off to invest in Indonesian mining and energy, Chief Development
Officer of PT Apple Coal Ben Lawson stated.
"No, it will absolutely not. Whatever you say, Indonesia is still great
place to invest. If you see China or India to invest in energy, it will
be difficult as they protect their resources. On the contrary, coal
export from Indonesia is very easy, and divesting those ownership? We
are still the majority of 49%!"
Mr. Lawson also stated energy 'matters' in Indonesia are easy to handle
with authorities.
"I have been 16 years in Indonesia and when matters come, 'semua bisa
diatur'!" (everything could be arranged) he said.
The government has recently issued the new Government Regulation No.
24/2012 about the divestiture of foreign ownership of mining projects
which have no Indonesian ownership.
Based on the new mining law, foreign-owned mining companies are
obligated to divest its majority shareholder ownership down to 49% over
a period of time in accordance with a divestment schedule in tranche
sales at prices akin to market value at the time to an Indonesian
government body or an Indonesian national company.
